家庭傭工
Note: Before expending both money and time on a nonimmigrant visa application, please be aware that the majority of domestic helper applicants are unable to qualify for a visa to enter the United States.
The decision to grant a visa is based on the domestic helper's personal situation, not on the needs or position of the employer. The applicant must demonstrate that he/she has sufficiently strong family, social, economic or other ties to their place of residence to ensure that their projected stay in the United States will be temporary. Meeting this legal requirement is typically difficult for domestic helpers because they have already demonstrated a willingness to depart their original residence to seek contract employment in another country.
For Employers
Employers are not parties to the visa interview and are not permitted to accompany their domestic helpers to a visa interview.

FREQUENTLY ASKED QUESTIONS
The officer said that I did not have "adequate ties" but did not tell me specifically why I could not get a visa.
Unfortunately we cannot give you a checklist of what constitutes "adequate ties" since every case is different. There is no particular checklist, only a set of factors that consular officers evaluate. Some factors that we consider include your length of time in Hong Kong or Macau, length of time with current employer, prior travel, and family ties to your home country and/or habitual residence.
Why do I need a US contract? I am going for vacation with my employer to the United States.
Even if your employer is on vacation, your travel must include a contract because you will be working. To work in the United States, you must have a contract that complies with labor laws in the United States. These laws include minimum wage laws and other regulations.
My employer is applying for me to go to the United States -- why did you refuse?
You are the visa applicant. The decision to refuse or grant a visa is based on your personal situation, not on the needs or position of your employer.
Will a refusal today hurt my chances to qualify in the future?
A prior refusal for a non-immigrant visa is a matter of record; however, it is not grounds for refusing your application in a later interview. A refusal for a non-immigrant visa means that your personal situation does not meet the rules for a US visa at the time of the interview. If you have a substantial change in your circumstances, you are welcome to reapply for a visa. Note: in order to reapply, you must go online to schedule a new appointment, pay the fees and start the process over again. You should do this only if you have a substantial change in your situation.
The officer did not consider my family and economic ties to my home country.
You have departed your home country to work in Hong Kong or Macau. Therefore, it is unlikely that a consular officer will determine that you have strong ties to your home country, and will not place great weight on those ties when deciding your eligibility for a visa.
